Thomas Barber senior was born in 1749 at Antrobus, Over Whitley, Cheshire. He died 27 April 1818 and was buried at Gt. Budworth on 1 May 1818. In his Will he names Mary Kinder, his daughter, as one of his beneficiaries. His children according to his Will are Thomas (see note below) (who was the main beneficiary), James, John, Peter, Mary (Kinder), and William.
This is the last Will and Testament of me THOMAS BARBER of the Hamlet of Antrobus the Lordship of Over Whitley and County of Chester who am of sound disposing mind, memory and understanding, for which I desire to be thankful First I will that all my just debts funeral expences and the charges of the Probate of this my will be paid Then I give devise and bequeath unto my loving wife all my property houses buildings and personalty of every sort whatsoever to enjoy and possess during her natural life Then at after her decease I give devise and bequeath unto my son THOMAS BARBER all my Lands and Buildings which I may die seized possessed of or entitled to, to him his Heirs Executors Administrators or assigns for ever subject nevertheless to the following charges that is to say To my son JAMES BARBER his heirs and assigns I order and direct to be paid by my Executors hereinafter named in trust the sum of sixty pounds sterling To my son JOHN BARBER his heirs and assigns the sum of eighty pounds sterling To my son PETER BARBER his heirs and assigns the sum of sixty pounds sterling To my daughter MARY KINDER her Heirs and assigns the sum of one hundred pounds sterling To my son WILLIAM BARBER’S son PETER BARBER his heirs and assigns the sum of twenty pounds sterling And to my son WILLIAM BARBER’S daughter MARY BARBER her heirs and assigns the sum of twenty pounds sterling And all the above legacies to be paid within twelve months after my decease and the decease of my loving wife But provided either my grandchildren above mentioned should die without lawful issue before they are entitled to any benefit from this my will, then in such case it is my Will that the Survivor shall receive the sum intended for my grandchild had he or she lived but should they both of them die without lawful issue before they have any just claim on this Will, then I will that the money intended for them should be equally divided between the rest of my Heirs, their heirs and assigns Also it is my Will that my son THOMAS BARBER his Heirs and Assigns shall receive and be entitled to all the Live Stock, Implements in Husbandry, Dairy Vessels and Household furniture which I may die in possession of and after the decease of my Wife should she survive me But provided my Son THOMAS BARBER should die without lawful issue before he comes in possession of the property intended for him by this my Will it is my mind and will that the Property hereinbefore mentioned for him should be sold as soon as may be convenient after my decease and the Decease of my loving Wife and the monies arising from the sale thereof to be divided equally share and share alike between my son JAMES BARBER, my son JOHN BARBER and my daughter MARY KINDER them their Heirs and Assigns And in case such sale should take place the receipt or receipts of my Executors or the Survivor of them their Heirs and Assigns to the purchaser or purchasers of such Estate shall be a good legal and sufficient discharge for the money which may be paid on account of such purchase It is further my Will that if any of my Heirs mentioned in this my Will should be dissatisfied or discontented with this Will so as to give my Executors unnecessary trouble and expence in their execution of the same then I will that such Person or Persons shall not be entitled to any farther benefit from this my will. I will also that my Executors shall be allowed all reasonable expences in their Execution of this my Will And lastly revoking all other Will or Wills made by me heretofore at any time, I do declare this to be my last Will and Testament, and appoint my friend THOMAS STARKEY of the Hamlet of Antrobus and my son THOMAS BARBER Executors of this my will in witness whereof I the said Testator do put my hand and seal this fifth day of April in the year of our Lord one thousand eight hundred and eighteen Signed sealed published and declared by the said Testator THOMAS BARBER as his last Will and Testament in the presence of us who have hereunto subscribed our names as witnesses in the sight and presence of the Testator and each other THOMAS BARBER’S mark x THOMAS PERCIVAL THOMAS BILLINGTON WILLIAM ELLAM THOMAS STARKEY and THOMAS BARBER the Executors in this Will named were sworn in common form and they further made oath that the personal Estate and Effects of the Testator within the Diocese of Chester were under the value of fifty pounds Before me RICH JONES Surrogate The Testator died the 27th day of April 1818 Probate issued dated 21st Sept 1818 |
